Prop 65 Warning Labels for THC in CBD Products

California’s Proposition 65 Adds THC to the List Chemicals Known to Cause Harm.

As of January 3rd, 2021, the State of California has mandated that all products sold to and from California have a warning label on any products that contain any amount of Delta-9 THC (Tetrahydrocannabinol.) This includes full spectrum hemp CBD products that contain only trace amounts under the legal limit of 0.3%.

In order to comply with the addition of ∆9-THC to California’s Proposition 65 list, we are required to add the Proposition 65 statement to our product labels:

WARNING: This product can expose you to Δ9-THC, which is known to the State of California to cause birth defects or other reproductive harm. See: www.P65Warnings.ca.gov.

The Prop 65 warning is required by the state of California to warn consumers about exposure to ingredients regardless of the level of those ingredients in products. While the presence of a Prop 65 warning does not mean that a product is unsafe for its intended use, the law requires that we warn consumers about the potential for risk.

If you see the Prop 65 warning on our labels, you might be wondering if the CBD product you purchased is safe. Yes, our products are still safe and have always been safe. California is known to operate out of an overabundance of caution and has begun mandating warnings on common items like coffee and potato chips. The study prompting this warning was for elevated levels in an animal-only study. Moreover, many more studies exist showing reductions in cancer and no effect on reproductive health with use of moderate amounts of THC.

Prop 65 label warnings frequently cause confusion and concern. Seeing this label may raise alarm about the safety and quality of full spectrum CBD products, but please be assured that our ingredient sourcing and manufacturing is still maintaining the highest quality standards. Even though there are extensive studies showing the health benefits of THC, the state of California has decided to add it to the Prop 65 list.
